Terms and conditions

Article 1) Conditions

Vehicles will be rented only to persons older than 18.

Documents required for rental

Driving license, Id card, social security number. Stev 2 s.r.l. (hereafter under the name of “Lessor) shall consign to the Lessee (hereafter under the name of “Lessee”) the chosen vehicle in accordance to the present agreement, in good state of repair and, in the very same conditions, the Lessee shall return it to the Lessor at the end of the renting period. The Lessee, by taking delivery of the vehicle through subscription of the rental agreement jointly with the agreement on the current general conditions, hereby declares to have verified that the motorbike is in good state of repair and that it is adequate for the agreed purpose of use. The Lessee commits himself not to give any false information on his personal details, his age, his address and on the existence of statutory requirements for driving certifications and licensing, expressly relieving the Lessor of all injurious consequences deriving from any false declaration given by the Lessee. Anyone who signs the leasing agreement on behalf of a third party shall be jointly held responsible for the execution of all duties stated in this rental agreement. In all cases the client shall be held responsible for all actions and omissions of anyone other than the client driving the vehicle.

Article 2) Lessee duties

The lessee commits to:

  1. to drive the vehicle wearing a DOT approved helmet; transport a passenger wearing a DOT approved helmet; to keep the vehicle, together with all its equipment, with the utmost diligence and in accordance with all current legal regulations;
  2. To make sure that greasing, lubrication and brake oil are in the right condition to guarantee the vehicle performance an safety during the rental period; to use the motorbike with care and discretion, by not putting it under high stress conditions or driving at excessive speed, or by using it in races and competitions. Every damage and failure suffered by the motorbike through negligence, malice and carelessness (fallings, crashes, dents) shall be considered dependent on the Lessee. In case of damage exceeding the value of the vehicle, the damage shall be considered dependent on the lessee and shall be considered equal to the market price of the vehicle;
  3. To directly provide for the payment of any fines, tolls, parking tolls contested during the rental period;
  4. to indemnify the Lessor from any pretense and/or demand made by third parties for suffered and/or caused damage to goods and properties connected to this rental;
  5. To refund the Lessor, with an invoice, of every expense, along with legal expenses, that the Lessor itself shall sustain to obtain the fulfillment of monetary obligations on any term;
  6. It is agreed that if, on direct request of the Lessee, the return of the vehicle and its keys has been authorized by the Lessor during the venue’s closing time, the rental will expire in the exact date and time when the premises open again;
  7. To return the vehicle in the very same conditions in which it was at the moment of its rental. Any damages will be assessed when the motorcycle is returned and the costs of repairs will be paid by the Lessee;
  8. The Lessee acknowledges that he is not entitled of any right on the rented vehicle and on its accessories and, therefore, cannot use it in any different way than those expressed in the rental agreement.

Article 3) Lessee liabilities

The lessee agrees to drive or use the vehicle personally and commits not to give for any reason, for free or after payment, the vehicle to third parties and, specifically, commits that the motorbike shall not be used:

  1. In a state in which the green insurance card is not valid;
  2. To transport persons or things under compensation;
  3. To push or pull objects;
  4. Under the effects of drugs, narcotics, alcohol or intoxicants, that is to say, other substances capable of impairing reaction times and clear thinking;
  5. In races, in circuit, competitions or speed racing;
  6. For any purpose that can be considered against the law;
  7. To drive in forbidden areas and in restricted traffic areas of access or service for harbors or airports;
  8. By a person that has given false information regarding his age, name or address to the Lessor;
  9. By a person which is not at least 18 years old.

Article 4) Lessor limitations of liability

The lessor cannot be held responsible towards the Lessee, that is to say the driver of the motorcycle and/or of its passengers, for damages of whatever nature, including economic damages that the same may suffer for a functioning failure of the vehicle or for accidents. By return, the Lessor cannot also be held responsible for any type of damage that occurred because of theft, riots, war, reasons of force majeure and any unforeseeable circumstances.

Items forgotten or left on a rented motorbike by the Lessee, shall be considered as abandoned and the Lessor is not bound to keep them in custody or to return them.

Article 5) Reservation and cancellation

Reservation of vehicles can be conducted through e-mail, fax, phone or on discoverent.it official website. Upon reservation, the Client shall provide a copy of his driving license, of his id card and social security number. To confirm the reservation, he shall also pay 100% or 30% (depending on the request channels) of the fare depending on the chosen motorcycle and the selected period of time.

The client commits not to give any false documents and/or false information hereby assuming all responsibility caused by the violation of the present clause. In case of cancellation by the Client, the Lessor will hold the amount paid as deposit for the reservation.

Article 6) Delivery and return

The vehicles are delivered at the rental stations indicated on the website discoverent.it or in other places agreed with the Lessor, where they shall also be returned on the agreed time and date. Vehicles are delivered in good state of repair and functioning.

The client shall verify the rented vehicle condition and shall point out on paper, any comments on the state of the vehicle chassis or any mechanical issue found. It is forbidden to return the vehicle during the Lessor office closing hours and, in any case, the vehicle must be returned directly to an appointee, unless previous agreement with the Lessor. In case of a delay exceeding 30 minutes on the agreed time of return, the Client shall pay a fine (see Article 14).

The vehicle shall be returned to the Lessor with all its accessories, keys and all existing documents, otherwise the Client commits to the payment of a fine (see Article 14). In case of an early return by Client choice or, in any case not because of need, fault or request of the Lessor or because of technical faults not attributable to the client, it will not be possible for him to obtain a refund for the residual renting period fee. In the moment in which the vehicle is returned, the client commits to communicate to the Lessor about any fines he got during the renting period.

Article 7) Payments reservation and cancellation

On reservation, an upfront payment amounting to 30% of the renting price is required, while the rest of the amount shall be paid on delivery of the vehicle. An invoice will be issued for both payments. Payments can be made: cash, debit card, credit card, bank transfer.

In case of late payment, an interest rate determined by the European Bank and increased by 3% shall be applied. An invoice will be issued for the payment. In case of cancellation within 30 days from the start of the rental period, the deposit will be held and may be used for a rental within the same calendar year, depending on vehicle availability. In case of cancellation between 30 and 15 days from the start of the rental period, the deposit will be collected. In case of cancellation within the last 15 days from the start of the rental period, the whole renting cost will be charged.

Article 8) Security deposit

At the moment of rental, a Credit Card registered to the same subscriber of the contract will be requested as a mean of security. Credit card refers only to those with embossed stamped number and part of the major banking channels: Mastercard, Visa and others, except Amex and American Express circuit. The deposit shall not be collected but it may be used to meet the expenses in case of key or vehicle travel document loss. The deposit can also be used to cover damages to third parties that involve the payment of a deductible. The Lessee commits to compensate the Lessor for any damage related to vehicle theft or for its parts not covered by the insurance policy of the vehicle, and commits to pay in full the value of the deductible indicated in the insurance policy. With this Agreement, only the possession of the motorcycle is transferred to the Lessee and the possess of such vehicle lies in full availability to the Lessor. The Lessor reserves the right to terminate the agreement, in case of violation of the articles of this agreement and at its own discretion. The Lessor can also request the Lessee the immediate return of the motorcycle, in this case by returning the difference in price of the period of missed use, that is to say, to retain the amount in case some damages that exceed the value of the deposit are found on the motorcycle.

Article 9) Insurance cover

Insurance- All vehicles are covered by insurance on civil liabilities, an insurance that covers all damages caused by third parties, except those caused by the driver. The validity of the insurance coverings made available by the Lessor is subject to the corresponding requirements by the Client. The client is not covered by any insurance:

  1. For damages to the rented vehicle whereas these were caused in accidents of which the client is responsible;
  2. For damages to the rented vehicle whereas the client is not able to supply data and elements to the reconstruction of the event or for the identification of the vehicle driver;
  3. For damages concerning the driver, the passengers and their items and luggage or if the vehicle is used for illicit activities, for speed racing or for any type of competition, or towing and transporting of goods; in case the rented vehicle is driven by a person under the influence of alcohol or drugs;
  4. For damages caused by accidents not declared in time;
  5. For intentional damages or damage caused by an act of disrespect of the road code, or caused by Client’s negligence;
  6. For any hazard in the Countries not mentioned on the “green card”;
  7. for damages resulting from transport on tow truck and/or repatriation of the vehicle itself;
  8. For damage depending on civil liabilities and damage to third parties and events that exceed the limit of liability;
  9. For damages resulting from vandalism, weather, riots, explosions, fire and earthquakes;

Fire / Theft

In case of theft, fire or attempted theft: in all cases of theft and fire the Client is compelled to file a complaint to competent authorities (Polizia or Carabinieri) and send the original copy to Stev 2 s.r.l. within 24 hours.

The client is solely responsible in case of theft or burning of the vehicle. Such responsibility is conventionally limited, except in case of malicious intent or gross negligence, to a maximum sum dependent on the rented vehicle and specified as “percentage excess” in the renting agreement; the damage sustained is to be paid fully by the Client in case of malicious intent or gross negligence, in case the Client does not give back the Keys to the Lessor, and in case the insurance does not completely reimburse the damage.

Stev 2 s.r.l. may, at its sole discretion, not grant a substitute vehicle in case of theft, fire or serious accident, regardless of the reasons that determined the event. The rental fee shall be payable until the delivery date of the complaint’s copy, in addition to the insurance fee.
Damages sustained by the vehicle are subject to a deductible for every single happening. If the driver subscribes to the optional policies made available by the Lessor, the insurance fees can be reduced by 50 or by 75%.

Article 10) Accidents

In case of accident, the client compels to:

  • Immediately inform the Lessor by phone, sending the CID (Convenzione Indennizzo Diretto – Direct Reimbursement Convention) detailed in its every part or, sending a detailed declaration of the events within the next 12 hours;
  • Inform the closest police authorities;
  • Do not disclose any declaration of liability;
  • Take note of all the names and addresses of the different parties and of the eventual witnesses, together with the details of the Insurance companies of the involved vehicles (company, policy number, agency);
  • Supply any other useful information to the Lessor;
  • Follow the instructions that the Lessor will give regarding vehicle custody and/or repair.

The driver compels to reimburse the Lessor for any damage to the vehicle or to its components and accessories, he moreover compels to refund the administrative expenses for the accident in full. The driver must report within 12 hours from the event, on every accident (albeit minimal) that happened during the rental period of the motorcycle.

Article 11) Motorcycle Malfunctioning

In the event of a technical malfunctioning of the rented vehicle that is not imputable to the Client and that precludes the use of the vehicle itself, the Lessor will provide, if possible, to substitute the vehicle with a similar one. The Lessor, if it is not possible, will reimburse the driver with an amount of money equal to the unused part of the paid rental period. (reimbursement for further damage is excluded by agreement). The lessor compels to reimburse repair fees caused by vehicle malfunctioning to the Client, provided they are proven by an invoice registered to the Lessor and preemptively authorized by the Lessor himself. Repair invoices not authorized by Stev 2 s.r.l. shall not be reimbursed. Any damaged tire shall be repaired and paid in full by the driver and he MUST REPORT the damage to Stev 2 s.r.l. for obvious reasons of vehicle safety. Abandoning the vehicle without any authorization entails the obligation for the driver to reimburse all direct and indirect expenses to recover the vehicle in addition to the payment of a € 500.00 fee.

Article 12) Confiscation of the vehicle

In case of confiscation of the motorbike by legal authorities for any cause attributable to the driver, Stev 2 s.r.l. will charge the driver himself with the daily rental costs calculated on the current agreement, up until the vehicle is released, with a maximum sum equal to the vehicle substitution value calculated on the expiration date of the agreed rental period. In case the vehicle is at Stev 2 s.r.l. disposal, as a Lessor it will charge the driver with all the due payments up to the natural expiration of the lease agreement together with the payments charged by the owner of the motorcycle.

Article 13) Additional Forms of rental

Forms of Rental:

  • Week-end rental means from Friday evening (starting at 3pm) up to Monday morning (up to 11.30am);
  • VAT included prices and RC/third parties insurance with deductible in case of accident and theft/fire with insurance percentage excess;
  • For some vehicles a kasko insurance policy can be subscribed with a deductible (where applicable) with a daily surcharge;
  • Rental has a minimum duration of 1 day (max 24hrs);
  • Rental is not allowed with a driver’s permit;
  • The vehicle is delivered with a certain amount of gasoline and shall be returned with the very same quantity, otherwise a penalty will be charged to the client (see Article 14).

Article 14) Accessories and extra costs

It is possible to request and rent, depending on availability, and by paying a supplement, the following accessories:

  • Mileage cost for motorbike rent from € 0.20/km to € 0.25/km;
  • Drop-off after closing time (maximum 30 minutes tolerance) after 30 minutes another day of rental will be charged;
  • In case of delay in the drop-off, after 30 minutes from the agreed time, another day of renting will be charged;
  • Drop-off during public holidays (Sunday included) prior Lessor authorization € 50.00;
  • In case of drop-off of the vehicle during closing time, the closing of the agreement and the associated check for damages and vehicle functioning will be carried out during the regular opening hours: from Monday to Friday from 8.30am to 1:00pm and from 3:00pm to 7:00pm, Saturday from 8:30am to 1:00pm, Sunday closed;
  • Dropping off a vehicle with a smaller fuel quantity. Filling the tank costs € 15.00 for the service to which will be added the price of fuel (the price of fuel at the moment of the subscription of the agreement will be applied)
  • Damaging, Loss or theft of the Helmet € 210.00
  • Damaging, Loss or theft of technical jacket € 300.00
  • Damaging, Loss or theft of the security chain € 45.00
  • Damaging, loss or theft of Helmet security chain € 25.00
  • Damaging, Loss or theft of GPS € 720.00

Article 15) Home delivery

The price for home delivery shall be intended only for the drop-in or drop-off.

  • from 1 Km to 50 Km € 75.00
  • from 51 Km to 100 Km € 120.00
  • from 101 Km to 150 Km € 150.00
  • from 151 Km to 200 Km € 180.00
  • from 201 Km to 250 Km € 220.00

The distance is calculated starting from the offices of Stev 2 s.r.l. Strada Glomerelli, Trav. 4 Bari - 70132 (BA).

Article 16) Penalties

  • Loss and/or damage and/or theft of documents € 250.00
  • Loss and/or damage and/or theft of keys € 500.00
  • Loss and/or damage and/or theft of vehicle € 700.00
  • Abandoned vehicle € 2000.00

Article 17) Litigations

The following rental Agreement is regulated by Italian Law. For every litigation resulting from relationships regulated by “Contractual Documentation”, the place of competent jurisdiction is the one where the registered office or the residency of the Lessor is (place of jurisdiction Bari(BA)).

Article 18) Translation

In all the differences between the present English version and the original Italian document, the Italian version will always prevail, as the English version is a mere translation of the former.
